1. Agreement to Terms

By accessing or using Driving For Dollars Pro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Driving For Dollars Pro is a real estate investment platform that provides:

D4D (Driving for Dollars) lead capture and management
ARV (After Repair Value) calculation tools
Exit strategy analysis and comparison
Team collaboration and gamification features
Property data enrichment services
Renovation tracking and budget management
A deal marketplace where users list properties and contracts for other investors to find (see section 12)

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

4. Subscription and Payment

Some features of Driving For Dollars Pro require a paid subscription:

Subscriptions and credit packs are sold on the web via Stripe (card) or Circle (USDC), and within our mobile apps via the platform's billing system (Google Play Billing on Android)
Subscriptions are billed on a monthly or annual basis and renew automatically until canceled
You may cancel your subscription at any time. Purchases made through Google Play are managed, and may be canceled or refunded, through your Google Play account subject to Google's policies
Credits are a prepaid, consumable digital good and are generally non-refundable once used
Refunds are otherwise provided in accordance with our Refund Policy
Prices are subject to change with 30 days notice

5. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on the rights of others
Transmit malicious code or interfere with the Service
Attempt to gain unauthorized access to our systems
Resell or redistribute the Service without authorization
Use automated systems to access the Service beyond normal usage
Scrape, bulk-download, or systematically extract property or owner data from the Service, or resell or redistribute that data, beyond the exports the Service provides for your own use

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Driving For Dollars Pro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Your data remains your property, and you grant us a license to use it solely for providing the Service.

"Your data" means what you enter or upload, such as your leads, notes, photos, documents, and deal figures. It does not include public records we retrieve from government sources (for example, the owner of record, tax-roll mailing address, assessments, and sale history). We may keep those public records in a shared reference store and use them to operate and improve the Service for all customers.

7. Data Accuracy Disclaimer

While we strive to provide accurate property data and calculations, Driving For Dollars Pro makes no warranties regarding the accuracy, completeness, or reliability of any information provided. ARV calculations, seller motivation scores, and exit strategy analyses are tools to assist your investment decisions but should not be the sole basis for any real estate transaction. Always conduct your own due diligence.

Public property records are published by third parties. They may be out of date, incomplete, or mis-transcribed, and may differ between sources. They are provided for real estate research only and must not be used to decide a person's eligibility for credit, employment, insurance, or housing.

8. Limitation of Liability

In no event shall Driving For Dollars Pro , nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide at least 30 days notice before any changes become effective. Your continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. Marketplace Listings

The Service lets you publish a listing of a property or a contract interest so other users can find it, in the marketplace and on a public deal page. Each time you publish a listing, you represent that:

You have the right to market it. Either you hold a signed purchase contract with the owner that allows assignment (or you have the owner's written consent to assign it or double close), or you are a licensed real estate agent with a current written listing agreement or the owner's written authorization to market the property.
What you state in the listing is accurate to your knowledge, including the price, condition, contract dates, earnest money, occupancy, and any known title or disclosure issues. You will update or withdraw the listing promptly when that changes or your contract or listing agreement ends.
You follow the laws and rules that apply to you. These include real estate licensing laws, your state's rules on marketing a contract you don't own (including any required license, registration, or written disclosure), advertising and fair housing laws, and, for agents, your MLS and brokerage rules.
If you list as an agent, the license details on your profile are accurate and current. They are shown publicly on your agent listings because advertising rules require it.

We do not verify contracts, listing agreements, licenses, property condition, or any other statement a seller makes. "Seller-attested" on a listing means the seller made the statements above when publishing. It is not a review or endorsement by Driving For Dollars Pro. Documents you upload as proof stay private to your workspace and are never shown to buyers, but our staff may review them to investigate a report or check that a listing follows these Terms.

Driving For Dollars Pro is not a real estate broker, agent, title company, or escrow agent, and is not a party to any transaction between users. Buyers must do their own due diligence and should confirm a seller's authority and the contract terms before relying on them.

We may remove, hide, or limit any listing, and suspend your access to the marketplace, at any time, including when a listing is reported, appears inaccurate, or when we cannot confirm that the seller controls the contract. You are responsible for your listings and agree to cover the claims, losses, and costs that arise from a listing that breaks the representations in this section.
